These terms are a straightforward agreement between you and Nine Cats Software Inc. about your use of Vinyl Frontier.

Agreement to these terms

By creating an account or using Vinyl Frontier, you agree to these terms. If you do not agree, do not use the service. The Vinyl Frontier privacy notice explains how we handle personal information.

Using Vinyl Frontier

You may use Vinyl Frontier only if you can legally agree to these terms. Children are not intended to create accounts independently. If you add information about another person, you are responsible for having the authority to do so.

Accounts

Vinyl Frontier uses Sign in with Apple for account access. You are responsible for protecting access to your Apple Account and devices and for activity under your Vinyl Frontier account. Tell us promptly if you believe your account has been used without permission.

Subscriptions and billing

Vinyl Frontier requires an active monthly auto-renewable subscription purchased through Apple. The App Store shows the price that applies to you and whether you are eligible for a seven-day free trial. Payment is charged to your Apple Account, and Apple manages billing, cancellation, and refunds.

A free trial automatically becomes a paid monthly subscription unless it is cancelled at least 24 hours before the trial ends. The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current billing period. You can manage or cancel it in your Apple subscription settings.

Apple Family Sharing is enabled. Apple decides whether a family member receives shared access. A family member using shared access does not control the subscription owner’s billing or cancellation.

Without an active entitlement, you may sign in but cannot use ordinary Vinyl Frontier features or collection data. You retain access to subscription recovery and management, support, legal information, account deletion, and sign-out. Deleting your Vinyl Frontier account does not cancel your Apple subscription; you must manage it separately through Apple.

Your collection and content

You keep ownership of information and content you add to Vinyl Frontier. You give Nine Cats Software a limited permission to host, process, copy, and display that content only as needed to operate, secure, and support Vinyl Frontier.

You are responsible for the content you add, including your ratings, storage choices, and any collection information you synchronize. Keep separate copies of information you cannot afford to lose.

Optional Discogs connection

You may choose to link a Discogs account after you sign in to Vinyl Frontier. Discogs is an optional connection for collection data; it is not an account-login provider for Vinyl Frontier. You can unlink Discogs in the app.

Your use of Discogs is also governed by Discogs’ terms and privacy notice. We do not control Discogs and are not responsible for its availability, content, or changes.

Acceptable use

Do not use Vinyl Frontier to:

  • Break the law or another person’s rights.
  • Upload malicious code or content intended to harm, deceive, harass, or exploit anyone.
  • Interfere with the service, bypass access controls, probe for vulnerabilities, or access accounts or data without permission.
  • Reverse engineer, copy, or modify the app except where applicable law expressly permits it.
  • Use automated means to scrape, overload, or disrupt the service.

Third-party services

Sign in with Apple and, if you choose to use it, Discogs are third-party services. Their terms and privacy notices apply to their services. If you obtain Vinyl Frontier through Apple’s App Store, Apple’s standard end-user licence agreement governs the licence to the app unless a valid custom licence is provided through the App Store. These terms govern your Vinyl Frontier account and service use.

Service changes and availability

We may update, change, suspend, or discontinue parts of Vinyl Frontier. We try to operate the service reliably, but we do not promise that it will always be available, uninterrupted, secure, or error-free.

Our software and materials

Nine Cats Software and its licensors own Vinyl Frontier, including its software, design, branding, and other materials, except for content supplied by users or third parties. These terms do not transfer that ownership to you.

Suspension, termination, and account deletion

You may stop using Vinyl Frontier at any time and may schedule account deletion using the in-app account-deletion control. You may cancel deletion during the recovery period shown in the app. We may suspend or end access if you materially breach these terms, create risk or harm, or if we discontinue the service. Where reasonable, we will give notice before ending access.

Disclaimers

To the extent permitted by law, Vinyl Frontier is provided “as is” and “as available.” Nine Cats Software disclaims warranties that are not expressly stated in these terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms excludes warranties or rights that cannot legally be excluded.

Limits on liability

To the extent permitted by law, Nine Cats Software is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, goodwill, or opportunities arising from Vinyl Frontier. Nothing in these terms limits liability where doing so would be unlawful, including liability for fraud or wilful misconduct.

To the extent permitted by law, Nine Cats Software’s total liability arising from Vinyl Frontier or these terms will not exceed the greater of the amount you paid for Vinyl Frontier during the 12 months before the event giving rise to the claim and CAD $100.

Governing law

These terms are governed by the laws applicable in Canada, without regard to conflict-of-law rules. The courts of competent jurisdiction in Canada may hear disputes relating to these terms. Mandatory consumer rights and any forum rights that cannot legally be waived remain unaffected.

Changes to these terms

We may update these terms when Vinyl Frontier, our practices, or applicable requirements change. We will post the revised terms here and change the date at the top. If a change materially affects your rights, we will provide additional notice where required. Continuing to use Vinyl Frontier after the revised terms take effect means you accept them.

General

If a provision of these terms is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition, reorganization, or sale of assets. These terms and the documents they expressly reference are the entire agreement between you and Nine Cats Software about Vinyl Frontier.
